TERMS OF SALE

• ALL SALES ARE FINAL.
• Artwork may be picked up at the gallery after the exhibition closes, or shipment may be arranged. 
• All SHIPPING and HANDLING FEES will be calculated individually. Once your purchase is complete, a staff member will contact you for further details.

Buyer’s Responsibility:

Subject to fulfillment of all applicable terms and conditions of this Agreement, when the buyer makes a purchase, the buyer shall immediately pay the total amount due, comprised of the purchase price of the Work and all applicable taxes and service fees.  

Service fees include credit card processing and wire transfer fees. The buyer may pay by check, wire transfer, credit card, or PayPal. 

By making a credit card purchase, the buyer irrevocably waives any charge-back rights the buyer may otherwise have under the buyer’s cardholder agreement or otherwise. If a credit card or wire payment is not approved, the buyer will remain personally liable for the total amount otherwise due. In all cases, payment will not be deemed made until we collect the total amount due in good, cleared funds.  

If the buyer fails to comply with any applicable term or condition of this Agreement, the buyer will be in default, and we will be entitled in our absolute discretion to exercise any or all of the following rights and remedies (in addition to any other rights or remedies available to us at law): (i) to hold the buyer liable for the total amount due, and for interest, commissions on the sale at our regular rates, and any and all legal fees and incidental damages; (ii) to cancel the sale or any other sale to the buyer, retaining as liquidated damages any amounts already paid by the buyer; and/or (iii) to resell the Work publicly or privately as permitted by applicable law, holding the buyer liable for any deficiency between the total amount originally due and the price realized on resale, as well as any costs, expenses, damages and legal fees associated with both sales. 

Processing, Shipping, and Delivery:

All US orders will be processed and shipped after the exhibition closes. In most cases, this will be 4-6 weeks after closing. For rush orders and special requests, contact us at cameron@lymeacademy.edu. 

Unless otherwise specified, international orders will be processed, shipped, and delivered following exhibition closing. 

Packing and Shipping. We are not responsible for the act or omission of any packer, shipper, or common carrier in packing or shipping the Work. 

All Lyme Academy orders are packaged by hand with special care to protect your artwork. US Shipping: Within the US, our packages are shipped by common carrier, and shipping rates are calculated based on the size and weight of the artwork. Tracking information will be sent to the purchaser following shipment.

International Shipping: International orders are shipped via carrier or our art crating partner, depending on the artwork type. Unless otherwise specified, orders will be processed in 15 business days and delivered within 2-3 weeks. 

 Local Delivery: Local delivery of purchased artworks within a 50-mile radius of the Lyme Academy will occur within 15 days of the exhibition closing. Further delivery options may be arranged with Cameron Paynter; call 860.434.8725.

Packaging:

• All framed and unframed artworks will be flat-packed in an appropriate protective container
• Unframed original works are flat-packed to prevent creases
• Editioned prints and photography are sent in a tube with a protective layer of glassine
• Oversized works are either created or soft-packed and shipped via FedEx or with our art crating partner

Shipment Tracking:

A tracking number will be sent to you once your package has shipped.

Taxes:

The buyer is responsible for paying all sales, use, GST, VAT, or other taxes or charges imposed by law (e.g., a resale royalty) which may be imposed in connection with the sale of the Work that we are required to collect under applicable law and shall indemnify, defend and hold harmless (including reasonable attorneys’ fees) Lyme Academy from costs associated with any failure to do so.  

We are required to collect sales tax for any Work delivered in the same State as its current location.
